Recap 用户协议 / Recap User Agreement
本 Recap 用户协议（“协议”）管辖您对 Recap 应用程序（“Recap”或“应用程序”）的使用。在使用 Recap 之前，请仔细阅读本协议。通过注册或使用 Recap，您承认您已阅读、理解并同意受本协议以及 Recap 隐私政策、APAC 隐私附录和跨境数据传输协议的约束，所有这些均构成本协议的一部分。
This Recap User Agreement (“Agreement”) governs your use of the Recap application (“Recap” or “the App”). Please read this Agreement carefully before using Recap. By registering for or using Recap, you acknowledge that you have read, understood, and agree to be bound by this Agreement, together with the Recap Privacy Policy, APAC Privacy Addendum, and Cross-Border Data Transfer Agreement, all of which form part of this Agreement.

1. 服务范围 / Scope of Services
Recap 是一个在线用户研究平台，它使参与者能够：
- 通过招募筛选器申请并加入研究项目；
- 以视频、照片、音频、调查问卷答案或文本的形式提交回复；
- 通过应用程序访问项目任务、日程安排和说明；以及
- 在适用情况下，因成功参与而获得奖励或补偿。
Recap is an online user research platform that enables participants to:
- Apply for and join research projects through recruitment screeners;
- Submit responses in the form of videos, photos, audio, survey answers, or text;
- Access project tasks, schedules, and instructions through the App; and
- Receive rewards or compensation for successful participation, where applicable.
此外，Recap 为项目组织者提供了以下工具：
- 定义项目要求和资格标准；
- 管理和监控参与者提交的内容；
- 使用 Recap 的集成分析功能分析收集到的任务内容。
In addition, Recap provides project organizers with tools to:
- Define project requirements and eligibility criteria;
- Manage and monitor participant submissions;
- Analyze collected task content using Recap’s integrated analytics features.
1.1 奖励与补偿 / Rewards and Compensation
参与者可能有资格因成功完成研究任务而获得奖励或补偿。奖励需符合以下条件：
- 资格条件：只有当参与者满足所有项目特定要求，包括项目主办方设定的提交截止日期和质量标准时，才会提供奖励。
- 奖励的确定：奖励的类型、形式和金额（例如，货币支付、代金券或其他激励措施）仅由项目组织者确定，并在任务参与前向参与者传达。Recap 不确定或分配奖励。所有奖励均由项目组织者全权负责。
- 无保证：如果提交不完整、延迟、欺诈或不符合项目组织者的要求，奖励可能会被扣留。
- 税务与义务：参与者需对因获得奖励而产生的任何税款、申报义务或其他责任负责。Recap 对此类责任不承担任何责任。
我们可能会不时更新或扩大服务范围。
Participants may be eligible to receive rewards or compensation for the successful completion of research tasks. Rewards are subject to the following conditions:
- Eligibility: Rewards are provided only if participants meet all project-specific requirements, including submission deadlines and quality standards set by the project organizer.
- Determination of Rewards: The type, form, and amount of reward (e.g., monetary payment, vouchers, or other incentives) are determined solely by the project organizer and communicated to participants before task participation. Recap does not determine or distribute rewards. All rewards are the sole responsibility of the project organizer.
- No Guarantee: Rewards are not guaranteed and may be withheld if submissions are incomplete, late, fraudulent, or otherwise do not meet the project organizer’s requirements.
- Tax and Obligations: Participants are responsible for any taxes, reporting duties, or other obligations that may arise from receiving rewards. Recap bears no responsibility for such obligations.
We may update or expand the scope of services from time to time.
2. 用户权利和义务 / User Rights and Obligations
使用 Recap 时，您同意以下条款：
- 信息准确性：您必须在注册、筛选和研究任务中提供准确、完整的信息。虚假或误导性信息可能导致您被取消资格或账户被终止。
- 负责任使用：您不得使用 Recap 上传非法、有害、诽谤性或侵权的内容。您不得骚扰、虐待或伤害其他用户。
- 账户安全：您有责任保护您的账户凭据和账户下的所有活动。Recap 不会通过电话、电子邮件或 SMS 请求您的密码。
- 尊重他人权利：您不得试图获取或滥用其他用户的个人信息。
- 遵守法律：使用 Recap 时，您必须遵守所有适用的法律和法规。
违反这些义务可能导致警告、暂时或永久停用您的账户，或采取法律行动。
When using Recap, you agree to the following:
- Accuracy of Information: You must provide accurate and complete information in registration, screeners, and research tasks. False or misleading information may result in disqualification or termination of your account.
- Responsible Use: You may not use Recap to upload unlawful, harmful, defamatory, or infringing content. You must not harass, abuse, or harm other users.
- Account Security: You are responsible for safeguarding your account credentials and for all activity under your account. Recap will not request your password by phone, email, or SMS.
- Respect for Others’ Rights: You must not attempt to obtain or misuse the personal information of other users.
- Compliance with Laws: You must comply with all applicable laws and regulations when using Recap.
Violations of these obligations may result in warnings, temporary or permanent suspension of your account, or legal action.
2.1 知识产权 / Intellectual Property
Recap 应用程序的所有知识产权，包括但不限于其软件、设计和品牌，均归墨山网络科技（上海）有限公司所有。
您保留通过 Recap 提交的原始内容的所有权。但是，通过提交内容，您授予公司及其研究客户一项有限的、非排他性的、免版税的许可，仅用于相关研究项目的目的，使用、复制和分析此类内容。
All intellectual property rights in the Recap application, including but not limited to its software, design, and branding, are owned by Moshang Network Technology (Shanghai) Co., Ltd.
You retain ownership of the original content you submit through Recap. However, by submitting content, you grant the Company and its research clients a limited, non-exclusive, royalty-free license to use, reproduce, and analyze such content solely for the purposes of the relevant research project.
3. 隐私与数据保护 / Privacy and Data Protection
您使用 Recap 还受《Recap 隐私政策》、《亚太地区隐私附录》和《跨境数据传输协议》的约束，这些文件解释了我们如何收集、使用、共享和保护您的个人信息。
使用 Recap 即表示您承认并同意以下内容：
- 您的个人信息将根据这些文件进行处理。
- 研究客户可以访问《隐私政策》中所述的有限类别的数据（非识别性人口统计信息和任务内容）。
- 在法律要求的情况下，您明确且知情地同意跨境访问。

Your use of Recap is also governed by the Recap Privacy Policy, APAC Privacy Addendum, and Cross-Border Data Transfer Agreement, which explain how we collect, use, share, and protect your personal information.
By using Recap, you acknowledge and agree that:
- Your personal information will be processed in accordance with these documents;
- Research clients may access limited categories of data (non-identifying demographics and task content) as described in the Privacy Policy;
- You provide explicit and informed consent to cross-border access where required by law.
For more details, please review the linked documents, all of which are incorporated into this Agreement by reference and are binding on you.
4. 责任与免责声明 / Liability and Disclaimer
- 服务可用性：Recap 按“现状”和“可用”的原则提供。我们不保证不间断的访问，并且可能会因维护或改进而暂停或修改服务。
- 责任限制：在法律允许的最大范围内，本公司不对因您使用 Recap 而造成的间接、偶然、特殊或后果性损害承担责任。
- 责任上限：在法律允许的范围内，公司对因本协议引起或与本协议有关的任何和所有索赔的总责任不得超过（i）您在索赔前十二（12）个月通过 Recap 实际收到的直接赔偿总额，或（ii）一百美元（USD $100）中的较大者。
- 用户责任：您对您提交的内容及其产生的任何后果负责。
- 安全事件：虽然我们实施了严格的保障措施，但我们不能保证传输或存储系统完全安全。我们将采取合理措施来减轻任何未经授权的访问、黑客攻击或违规行为的影响。
- 不可抗力：公司对因超出其合理控制范围的事件导致的履约失败或延迟不承担责任，这些事件包括但不限于自然灾害、停电、电信故障、互联网中断、政府行为或其他不可抗力事件。
- Service Availability: Recap is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access and may suspend or modify services for maintenance or improvement.
- Limitation of Liability: To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, or consequential damages arising from your use of Recap.
- Liability Cap: To the extent permitted by law, the Company’s total liability for any and all claims arising from or relating to this Agreement shall not exceed the greater of (i) the total amount of direct compensation actually received by you through Recap in the twelve (12) months prior to the claim, or (ii) one hundred U.S. dollars (USD $100).
- User Responsibility: You are responsible for the content you submit and any consequences arising from it.
- Security Incidents: While we implement strict safeguards, we cannot guarantee that transmission or storage systems are completely secure. We will take reasonable steps to mitigate the impact of any unauthorized access, hacking, or breaches.
- Force Majeure: The Company shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, power outages, telecommunications failures, internet disruptions, government actions, or other force majeure events.
5. 争议解决与适用法律 / Dispute Resolution and Governing Law
本协议受中华人民共和国法律管辖，除非您居住的司法管辖区的强制性法律另有要求。
任何争议应首先通过善意协商解决。若协商失败，除非适用法律另有要求，争议可提交至公司注册地有管辖权的法院。
您居住国的强制性消费者保护法律也可能适用，并在法律要求的范围内优先于本协议。
This Agreement is governed by the laws of the People’s Republic of China, unless mandatory laws of your jurisdiction of residence require otherwise.
Any dispute shall first be resolved through good-faith consultation. If consultation fails, the dispute may be submitted to a court with jurisdiction in the place where the Company is registered, unless applicable law requires otherwise.
Mandatory consumer protection laws of your country of residence may also apply and will prevail over this Agreement to the extent required by law.
6. 协议的修改 / Modifications to the Agreement
我们可能会不时修改本协议，以反映我们服务或适用法律的变化。更新版本将在应用程序内或我们的网站上发布。
对于重大变更，我们将通过应用程序或电子邮件发出通知。如果在更新后的协议生效后您继续使用 Recap，则视为您已接受修订后的条款。如果您不同意更新后的条款，则必须停止使用 Recap。
We may modify this Agreement from time to time to reflect changes to our services or applicable laws. Updated versions will be posted within the App or on our website.
For material changes, we will provide notice through the App or by email. Your continued use of Recap after the updated Agreement takes effect constitutes acceptance of the revised terms. If you do not agree to the updated terms, you must stop using Recap.
